Merry Christmas and Happy New Year! The results of the arts competition "Magic of Christmas 2017"

KSP Team wishes you all a joyful and peaceful Christmas, lots of a happy time to share with your families and friends, and taking a step back from your everyday routines. May the New Year bring lots of joy, happiness, and achievement of your most daring goals. We would like to thank all our clients and partners for their trust. We also have the pleasure of announcing the results of the annual arts competition entitled “the Magic of Christmas”. This year we received many wonderful projects made by young artists from the Special School No 9 in Katowice named after Pope John Paul II. It was extremely difficult for us to choose the best three works, so we decided to additionally award some distinctions. Here are the results:

 

  1. 1st place – Ania Sierpień
  2. 2nd place – Adrian and Bartosz Zarzycki
  3. 3rd place – ex aequo: Szymon Kuryło and Michał Muszik

 

Additionally, the works made by Kamil Szymański and Igor Wiśniewski were awarded distinctions.


We would like to thank all students and their supervisors for participation in the competition and for creation of unique Christmas cards and decorations, which you can see by clicking the link.

KSP is a legal partner for the Polish crew at the 73rd edition of the Rolex Sydney Hobart Yacht Race in 2017

We are pleased to announce that our law firm has become the legal partner for the Polish crew of the Weddell yacht, a Grand Mistral 80 boat, at the prestigious Rolex Sydney Hobart Yacht Race.

 

Przemysław Tarnacki’s crew, representing the Ocean Challenge Yacht Club, will set off from Sydney on 26 December 2017, to face the challenge of one of the most extreme and thus – legendary – oceanic races, and reach the finishing line in Tasmania.

 

So far, this is the third Polish crew participating in a race of such significance. More than 100 crews from around the world are on the start list for this year’s edition. The Sydney Hobart Race was held for the first time in 1945 in one of the most difficult sailing regions. The race route is 630 nautical miles long and leads through the infamous Bass Strait, known for high winds and tall waves which make this stretch difficult in terms of navigation.

GDPR – Practical Guide for Entrepreneurs (downloadable version)

In half a year we are going to face substantial changes in the area of personal data protection. 25 May 2018 marks the effective date for the EU General Data Protection Regulation (GDPR).  GDPR - Practical Guide for Entrepreneurs, prepared by KSP experts, is a set of useful information and advice facilitating adaptation to the new regulations.

 

The guide offers advice on how to effectively implement the relevant procedures in an enterprise so as to ensure top level of personal data protection and smooth adaptation to the new legal requirements.  We have also prepared a GDPR implementation map, i.e. steps to be taken by each entrepreneur to meet the requirements.

We are proud! Our lawyer Maciej Michalak was 25th to finish the 9th PKO Silesia Marathon

IX PKO Silesia Marathon is behind us. We congratulate all participants for finishing the run and overcoming their own limitations. Our special congratulations go to the KSP team, which we strongly supported along the way. Maciej, Magda, Ela, Łukasz, Jakub, Marta – this was a real accomplishment! We are particularly proud of Maciej Michalak, our runner, who was 25th place finisher, with the result 2.53.19.

 

PKO Silesia Marathon was the first event held on the modernised Silesian Stadium. Over 4700 runners finished the marathon on a new track “Kocioł Czarownic” (the “Witch Cauldron”), supported by several thousand viewers. See you same time next year!

John Lemon vs Yoko Ono - KSP layers advise in the process of reaching settlement between a beverage producer and the widow of the artist

Tomasz Srokosz, Hugo Bałaziński and Natalia Gaweł provided advice to John Lemon, a Katowice-based producer of natural lemonades, in their dispute with Yoko Ono, the widow of the famous Beatle. Yoko Ono considered the use of ‘John Lemon’ name to infringe the trademark of her late husband’s name.  The John Lemon lemonade producer registered its trademark in the European Union in 2014. The John Lennon trademark was registered only last year.

 

As a result of negotiations, both parties managed to reconcile their interest. The owner of John Lemon brand considered it of essence to be able to prepare for rebranding. See the attachment for the company’s official comment. JOHN IS ON

Driverless cars, electric mobility, smart city. CIO Club in Jaworzno 12 October 2017

9th PKO Silesia Marathon with the finishing line at the Silesian Stadium. KSP is a legal partner of the event. On 1 October 2017, come to the Silesia Park join the run!

Yet another PKO Silesia Marathon is planned for 1 October 2017. For the ninth time, runners will have an opportunity to face the challenge of a 42.195 km race through Katowice, Mysłowice and Siemianowice Śląskie to Chorzów, with the finishing line – note – at the Silesian Stadium. It will be the first sports event at the Silesian Stadium after renovation. We don’t know how about you, but we simply can’t wait... like every year, KSP Law Firm is a partner of this largest running event in the Upper Silesia. This time, in addition to providing legal support, we actively participate in the race, counting on good times of our runners.

 

The PKO Silesia Marathon is the only race in Poland and in Europe that takes place in as many as 4 cities. In addition, it is one of the biggest running events in Poland, and the largest one in Silesia. All-Poland contest “Casus Master” organised by KSP and ELSA Katowice - results

It is time to announce the results of the “Casus Master” contest organised by KSP Legal & Tax and ELSA Katowice. The contest, addressed to law students, involved providing a solution to one of three legal cases presented by KSP in the field of civil law, criminal law or tax law.

 

The papers we received were of very high quality. The winner, with her analytical approach and linguistic style, is Ms Agnieszka Szary. The award was officially handed in to her on 27 June 2017 at KSP Head Office. Additionally, distinctions were also granted to: Mr Piotr Boroń, Ms Ewa Dreszer, Ms Martyna Małkowska and Ms Klaudia Radwańska.

 

We would like to congratulate to all participants and invite you to take part in the next edition. We wish to take this opportunity to remind the students of law and economics that practical placements with our law firm are not necessarily boring! We encourage you to submit your applications (practical placement with KSP).

TRAINING: EMPLOYING TEMPORARY WORKERS - changes in legislation, 6 June 2017, KSP

We would like to invite you to free training dedicated to changed regulations of the Act on emplyment of temporary workers, to take effect on 1 June 2017. 

 

During the meeting, we will discuss practical aspects of the changes, such as:

  • changes to temporary workers’ employment time limits,
  • maternity entitlements,
  • new obligations of the employer-user.

 

During the training we also plan to discuss the new list of offences related to employing temporary workers and the rights of the inspection authorities established to ensure that employer-users act in conformity with the law.

 

The meeting will be hosted by Maciej Pietrzycki (Legal Advisor) and Kamil Kozioł (Lawyer). We estimate that the meeting will take around 2 hours and will offer an excellent opportunity to ask for opinions regarding any questions you may have. During the training we will discuss the reasons underlying introduction of the mechanism in January 2017, as well as the practical aspects of its application. The 9th European Economic Congress to be held in Katowice on 10-12 May 2017.

The European Law Students' Association (ELSA) Poland organises All-Poland Internship Days for Law Students to be held on 21-24 March 2017 at the Faculty of Law and Administration of the University of Silesia. KSP would like to invite students to a meeting with Łukasz Pożoga to be held on 23 March 2017 (Thursday) at 11.50 a.m. at the Faculty of Law of the University of Silesia in Katowice (Hall 4), dedicated to preparation of effective procedural writs in civil law proceedings. Łukasz Pożoga is an experienced legal adviser and negotiator, specialising in litigation and arbitration. He is a graduate of the University of Silesia. The first training session will be held on 7 March 2017. It will be dedicated to Minimum hourly rate in contracts of mandate/provision of services, and delivered by KSP Employment Law Practice.

 

Piotr Krupa and Maciej Pietrzycki will discuss the rules of the minimum hourly rate changed as of 1 January 2017. They will explain who is to be paid the new rates and how to accurately determine the amount of remuneration and the payment date in the contract. You will also learn how to store and file documentation according to the new legislation, how to keep hourly confirmations of task performance and what sanctions are envisaged for a breach of the new regulations.

 

The meeting is addressed to employers and employer representatives , directors and HR staff.

 

The cost of the session is PLN 99 net per 1 person or PLN 149 net for two attendees from the same company. If you enroll for two training sessions organised by KSP, the costs of attendance is PLN 149 net per person for both sessions (other available training sessions are listed in the registration form).

Personal data - the new approach, i.e. … On 1 February 2017 we start a series of entries on our INTELLECTUAL PROPERTY LAW blog concerning the data protection reform. You are welcome to read our comments!

Upon the entry into force of the EU data protection reform, all entrepreneurs are required to adapt their data processing procedures to the new legislation. On 25 May 2018, the current Polish Personal Data Protection Act will be fully replaced with the General Data Protection Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016. The national supervision authorities will acquire the right, without limitation, to impose administrative fines. A fine can amount to as much as EUR 20 million, and for enterprises - up to 4% of their total annual global turnover in the previous financial year.

 

We have therefore decided to familiarise our readers with the new data protection rules which they will need to abide by in the near future.  The new legislation is discussed in a series of articles entitled Personal data - the new approach, i.e. ... to be published on our blog.

TRAINING:  Closing loopholes in the tax collection system - new mechanisms available for tax authorities  - 12 January 2017, Katowice

We would like to invite you to attent a seminar, part of the Morning Tax Meetings series, during which we plan to present the new mechanisms available for tax authorities to close loopholes in the Polish tax colleciton system (amendments to the tax oridinance act, the VAT Act and the CIT Act). Majority of the new regulations came into force on 1 January 2017.

We are going to discuss, among other things:

  • The tax evasion clause - a way to increase the inflows to the State Treasury?
  • A transfer - more convenient in terms of taxation
  • Share premium no longer tax-neutral
  • New reduced CIT rate - who can benefit from 15% tax?
  • Reverse charge on construction services
  • Financial and insurance services - restraints on VAT exemption
  • New rules for VAT deduction and reverse charge
  • Deletion from the VAT register - freedom of the tax authorities
  • Back to VAT sanctions for unreliable tax settlements: 20%, 30% or even 100%!
