We pro­vide ad­vice in the area of de­vel­op­ing sce­nar­ios, im­ple­ment­ing, fi­nanc­ing and op­er­at­ing PPP in­fras­truc­tural pro­jects. We ren­der ser­vices to pub­lic en­ti­ties (lo­cal gov­ern­ments) and pri­vate part­ners (in­vestors). We par­tic­i­pate in ten­der pro­ceed­ings, rep­re­sent in­vestors in ad­mis­sion and ap­peal pro­ceed­ings, draw up and ne­go­ti­ate con­tracts for in­fras­truc­tural pro­jects.

KSP lawyers are ex­pe­ri­enced in pro­vid­ing le­gal ser­vices to the largest in­fras­truc­tural pro­jects im­ple­ment­ed in Poland through PPP. Be­low we list se­lect­ed pro­jects we han­dled:

• Le­gal con­sul­tan­cy to a French share­hold­ers, con­nect­ed with or­ga­ni­za­tion­al struc­ture and op­er­a­tions of Poland’s first com­pa­ny deal­ing with wa­ter sup­ply and sewage dis­pos­al in the form of PPP. Com­pre­hen­sive le­gal due dili­gence of the Com­pa­ny, le­gal ad­vice on the pro­ject struc­ture, ar­ti­cles of as­so­ci­a­tion, mod­i­fi­ca­tion of con­tracts reg­u­lat­ing the PPP, le­gal as­pects of co­op­er­a­tion be­tween the com­mune and the pri­vate part­ner, reg­u­la­tions con­cern­ing the ob­jects of op­er­at­ing ac­tiv­i­ty, le­gal and tax due dili­gence.
• Le­gal ad­vice to a wa­ter sup­ply com­pa­ny op­er­at­ing in the form of PPP (in south­ern Poland) re­gard­ing the Act on Col­lec­tive Wa­ter Sup­ply and Sewage Dis­pos­al, com­plex civ­il law is­sues con­nect­ed with the own­er­ship ti­tle to wa­ter sup­ply and sewage dis­pos­al in­fras­truc­ture, as well as con­se­quences of an­ti-­monopoly reg­u­la­tions;
• Le­gal ad­vice pro­vid­ed to a lead­ing French com­pa­ny deal­ing with con­struc­tion of waste in­cin­er­a­tion plant un­der a con­ces­sion con­tract. Le­gal anal­y­ses of the new Act on Con­ces­sion for Con­struc­tion Works and Ser­vices, Pub­lic Pri­vate Part­ner­ship Act, ad­just­ment of the con­ces­sion con­tract to meet the re­quire­ments of Pol­ish law. Con­sul­tan­cy in the area of com­bin­ing PPP with the use of EU funds, con­sor­tium-re­lat­ed reg­u­la­tions, state aid, and reg­u­la­to­ry is­sues of waste man­age­ment.
• Com­pre­hen­sive ad­vi­so­ry ser­vices to the Com­mune of Sopot Mu­nic­i­pal­i­ty to pre­pare a pi­o­neer­ing pro­jects of town cen­tre re­vi­tal­iza­tion through PPP (rail­way sta­tion and neigh­bor­ing ar­eas).
• Le­gal ad­vice in the pro­cess of pro­vid­ing con­ces­sion for wa­ter sup­ply and sewage dis­pos­al in a large Sile­sian city. Han­dling the con­ces­sion pro­ce­dure aimed to se­lect the wa­ter sup­ply and sewage dis­pos­al net­work op­er­a­tor in the city.
• Le­gal ad­vice in con­ces­sion pro­ceed­ings aimed to get a pri­vate part­ner for col­lec­tive wa­ter sup­ply ser­vices in a com­mune of Małopol­skie Province.
