The EU General Data Protection Regulation has been in force for one year now. It is said that 2018 was the year of the GDPR and one of the most frequently repeated facts during this period was the potential severe penalties to be imposed for personal data breach.

 

The lawyers of KSP Legal & Tax Advice together with Andersen Global experts have prepared a brief comparative analysis including infringements and sanctions imposed in selected EU countries. Afternoon with Taxes: New VAT-related obligations - theory and practice, 9 July 2019, Katowice

KSP Legal & Tax Advice invites you to the Afternoon Meeting with Taxes to be held on 9 July 2019 at Vienna House Easy Hotel in Katowice. The meeting will be dedicated to new VAT obligations to take effect during 2019 and from 1 January 2020.

During the meeting, the KSP tax advisors:  Elżbieta Lis and Michał Wilk will discuss the following issues:

  • mandatory split payment,
  • risks involved in implementation of the white list of taxpayers,
  • new obligations regarding documenting intra-Community supplies,
  • changes to chain transactions,
  • new obligations in respect of cash registers,
  • the latest rulings and consequences of the ECJ’s judgment on fuel cards in case C-235/18 and on chargeability of tax for construction services in case C-224/18.

KSP initiated cooperation with the Ministry of Investment and Economic Development under a PPP project

We are pleased to inform you that KSP in consortium with ECM Group Polska S.A. signed an agreement with the Ministry of Investment and Economic Development for consultancy in the process of preparation and implementation of a public-private partnership agreement for Construction of a Health Resort Centre in Konstancin, intended to select the private partner. The value of capital expenditure for the project is approx. PLN 100 million.

 

The consultancy involves all aspects of implementation of the PPP projects, primarily assistance in legal, economic, financial as well as technical issues for the public partner, i.e. Centralny Szpital Kliniczny MSWiA (the Central Hospital of the Ministry of the Internal Affairs and Administration) in Warsaw.

Mandatory Disclosure Rules (MDR) - a new tax practice at KSP

The obligation of mandatory disclosure of tax schemes (MDR) took effect on 1 January 2019. Given the vague understanding of the regulations and the possibility for many transactions and activities performed by taxpayers being classified as tax schemes, to minimize the risk, entrepreneurs should take into account the regulations while planning their future transactions which may give rise to reporting obligations.   

 

What are tax schemes and who needs to report them to the National Fiscal Administration (KAS), who does the reporting apply to and what are the procedures? Our experts will be pleased to answer these questions.

Employment law changes in 2019. An invitation to a training event to be held on 12 March 2019 in Katowice

We are pleased to invite you to attend another event organised by KSP. This time, our Employment Law practice is going to deliver a training session dedicated to the employment law changes that took effect at the beginning of 2019.

During the training, participants will be familiarised with changes in regulations concerning labour unions and with aspects of implementation of the Employee Capital Plans (PPK). We will also discuss the new responsibilities involved in keeping the employment documentation, GDPR in HR, i.e. the current practice and approach of data protection authorities to data protection by employers, as well as the planned amendments to the labour code in this respect.

The training will be delivered by KSP experts:  Piotr  Krupa, Tomasz Srokosz, Maciej Pietrzycki, Kamil Kozioł and Karolina Wilk.

New rules of liability of collective entities and penal fiscal liability of management board members We encourage you to familiarise with the upcoming changes. Seminar - 27 February 2019 in Katowice.

Entrepreneurs, members of management boards, heads of legal and compliance departments are welcome to attend the information seminar dedicated to the new bill to govern liability of collective entities for commission of offences. The Act is to be the basis for entrepreneurs to implement consistent rules of compliance of corporate activities with the applicable legal regulations.

  • Effect of the regulations on mergers, divisions and transformations

Penal fiscal liability vs. the new tax regulations:

  • The anti-tax evasion clause and the penal fiscal liability
  • Who is accountable for a false statement regarding preparation of the transfer pricing documentation
  • New rules for collection of the withholding tax effective as of 1 January 2019, and liability of the management board for failure to collect the withholding tax at the right amount
  • Tax scheme reporting
