We are pleased to present to you a guidebook dedicated to the basic principles of drafting Terms of Reference (ToR), i.e. a document of key significance in public contract award procedures.
How to draft ToR? - practical guidelines 2014 are based not only on the current legal regulations on public procurement and the body of rulings issued by the National Chamber of Appeal, but - in the first place - on our experience in the area of public procurement, acquired when providing services to ordering parties and contractors. The Guidelines are intended for public law entities obliged to abide by the Public Procurement Law of 29 January 2004, and to contractors applying for contracts.
With our long-term practice, we are aware of the most frequent errors made by ordering entities in the course of contract awarding procedures. In the guidelines we provide hints on how to avoid them, and thus also how to avoid ToR-related appeals. Errors in Terms of Reference which are not corrected at the right moment may lead to misunderstandings related to the subject of contract, or even to cancellation of the tendering procedure.
